Terms of Service

Welcome to Nightset. These Terms of Service ("Terms") govern your use of trynightset.com (the "Site") and your purchase of products from Nightset LLC ("Nightset," "we," "us"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who can use the Site. You must be at least 18 years old to purchase from Nightset. By ordering, you confirm you're 18 or older and that the information you provide is accurate.

2. Our products are supplements, not medicine. Nightset products are dietary supplements. Statements on this Site have not been evaluated by the Food and Drug Administration, and our products are not intended to diagnose, treat, cure, or prevent any disease. Nothing on this Site is medical advice. Consult your physician before use if you take medication, are pregnant or nursing, are under 18, or have a medical condition. Always follow the label's suggested use and cautions.

3. Orders and pricing. All prices are in US dollars and may change at any time; changes don't affect orders already placed. We reserve the right to refuse or cancel any order — including for suspected fraud, pricing errors, or stock issues — and will refund any amount charged for a cancelled order. Displayed product images are illustrative; minor variations in packaging may occur.

4. Subscriptions. Subscription purchases automatically renew. By starting a subscription, you authorize us to charge your payment method the subscription price (plus any applicable tax) on a recurring basis — every 30 days — until you cancel. We'll email you a reminder approximately 3 days before each charge. You can skip, pause, reschedule, or cancel anytime through your account at trynightset.com, and cancellation takes effect immediately for any not-yet-processed renewal. Full details are in our shipping and refund policies, which are part of these Terms.

5. Shipping, refunds, and returns. Our Shipping Policy and Refund & Return Policy — including the 60-Night Guarantee and its one-refund-per-customer limit — are incorporated into these Terms. Where these Terms and those policies overlap, the specific policy controls.

6. Your account. You're responsible for the accuracy of your account information and for activity under your login. Notify us at hello@trynightset.com of any unauthorized use.

7. Reviews and submissions. If you submit reviews, photos, videos, comments, or suggestions to the Site or tag us on social media in content featuring our products, you grant Nightset a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business, including marketing. You confirm your submissions are your own, honest, and don't violate anyone else's rights. We may remove any submission at our discretion. (We'll still ask before featuring your content prominently — that's a courtesy, not an obligation under these Terms.)

8. Intellectual property. The Site and everything on it — the Nightset name, wordmark, label designs, copy, images, and page designs — belong to us or our licensors. You may not copy, resell, scrape, or commercially use any of it without our written permission.

9. Acceptable use. You agree not to misuse the Site: no unlawful activity, no interfering with the Site's operation, no attempting to access other customers' accounts or data, no automated scraping, and no fraudulent orders or abusive refund claims.

10. Third-party services. The Site uses third-party services (such as payment processing, fulfillment, and subscription management). We're not responsible for third-party sites we link to; their terms govern your use of them.

11. Disclaimer of warranties. Except as expressly stated in these Terms and our policies, the Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted or error-free. Individual results from dietary supplements vary, and no specific outcome is promised.

12. Limitation of liability. To the fullest extent permitted by law, Nightset's total liability for any claim arising out of your use of the Site or purchase of products is limited to the amount you paid us for the product giving rise to the claim in the 12 months before the claim arose. We are not liable for indirect, incidental, special, or consequential damages. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

13. Indemnification. You agree to indemnify Nightset against claims arising from your violation of these Terms or misuse of the Site or products, including use contrary to label directions.

14. Governing law and disputes. These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at hello@trynightset.com and give us 30 days to resolve the issue informally — most problems are fixed in days. Any dispute not resolved informally will be brought in the state or federal courts located in Wake County, North Carolina, and both parties consent to their jurisdiction. (Attorney flag: many DTC brands use binding arbitration with a class-action waiver here instead. That's a genuine legal-strategy decision with tradeoffs — have a lawyer make this call rather than defaulting either way.)

15. Changes to these Terms. We may update these Terms from time to time. The current version is always posted here with its effective date; material changes to subscription terms will be communicated by email before they take effect. Continued use after changes means acceptance.

16. Miscellaneous. If any provision is found unenforceable, the rest remain in effect. These Terms, plus the policies they incorporate, are the entire agreement between you and Nightset regarding the Site. Our failure to enforce a provision isn't a waiver of it.
